The COVID-19 pandemic has led to the widespread use of online hearings in arbitral proceedings, raising questions about the impact of such proceedings on the determination of facts underlying a dispute. This article explores the extent to which online hearings may hinder arbitrators’ ability to assess witness credibility by drawing upon the cognitive psychology literature on truthfulness determination and lie detection. A survey of the literature suggests that the ability to differentiate truthful from dishonest statements through verbal and nonverbal cues (...) is limited, leading to the notion that observing behaviors like fidgeting, gaze aversion, vocal pitch, or body posture is not particularly relevant in assessing the credibility of a witness. Instead, focusing on the content of what is reported appears to be the most relevant strategy to determine credibility. Therefore, research does not support the idea that face-to-face contact with witnesses is essential to determine the facts of a dispute. Still, the use of in-person hearings may, in practice, continue to be preferred due to underlying cultural assumptions regarding the nature of hearings, the facilitation of communication between parties, counsel, and the tribunal, and a general sense of _Zoom fatigue_. Em diversas ocasiões, Leibniz recorre à autoridade de Aristóteles a fim de roborar sua tese da verdade como inerência do predicado ao sujeito da proposição. Não é, contudo, evidente em que medida a filosofia aristotélica poderia oferecer amparo a essa reivindica- ção. Afinal, a Aristóteles tradicionalmente se atribui uma concepção de verdade diferente, consistente em uma relação de correspondência entre a proposição e a realidade que ela se destina a descrever. Sem discutir a conhecida tese da verdade como correspondência, este (...) trabalho é dedicado a investigar em que medida os escritos de Aristóteles permitem que Leibniz respalde neles as suas afirmações. Para tanto, a presente investigação estará focada nos Primeiros e os Segundos Analíticos, obras em que Aristóteles expõe sua teoria do racio- cínio e da demonstração. Visa-se averiguar se, e sob que condições, a noção de inerência ali mobilizada pode ser assimilada à noção leibniziana de inerência. (shrink)

O presente ensaio visa apresentar de forma breve e modesta uma introdução à filosofia da mente, deste modo, abordaremos os seguintes tópicos: I) a relevância e a contribuição do dualismo para a filosofia da mente, posteriormente surgindo a reflexão sobre mente-cérebro; e, finalmente, II) o argumento do zumbi filosófico. A partir desta apresentação conclui-se que os tópicos levantados sobre a relevância do dualismo para a filosofia da mente e debate em torno do argumento do zumbi filosófico contribua para a inquietação (...) e investigação sobre a mente. Information is a central notion for cognitive sciences and neurosciences, but there is no agreement on what it means for a cognitive system to acquire information about its surroundings. In this paper, we approximate three influential views on information: the one at play in ecological psychology, which is sometimes called information for action; the notion of information as covariance as developed by some enactivists, and the idea of information as minimization of uncertainty as presented by Shannon. Our main thesis is (...) that information for action can be construed as covariant information, and that learning to perceive covariant information is a matter of minimizing uncertainty through skilled performance. We argue that the agent’s cognitive system conveys information for acting in an environment by minimizing uncertainty about how to achieve her intended goals in that environment. We conclude by reviewing empirical findings that support our view and by showing how direct learning, seen as instance of ecological rationality at work, is how mere possibilities for action are turned into embodied know-how. Finally, we indicate the affinity between direct learning and sense-making activity. (shrink)

Describing a Mundus Novus was a very singular task in the sixteenth century. It was an effort shaped by a permanent inherent tension between novelty and normality, between the immense variety of new facts and the demand of credibility. How did these inner strains affect the narrative style of the first descriptions of the natural world of ‘the Indies’? How were the first European observers of the nature of America able to simultaneously transmit the idea of immensity and regularity, and (...) that of novelty? How did they attempt to describe new worlds knowing that there was a lot – perhaps too much – to tell? This paper focuses not on the much-discussed epistemological issues related to those questions, but on their narrative and stylistic consequences. We argue that the first Europeans meeting the new realities of the Americas or India had to meet new challenges, and these translated into texts with specific characteristics. Thus, their first descriptions are essentially different from the texts about the natural world that were written before or after the ‘discovery’. We show that they adopted very specific discursive approaches, and were deeply influenced by the credibility strategies of the medical profession in which they had been trained. (shrink)

In this paper we put forward the thesis that qualia are tropes (or qualitons), and not (universal) properties. Further, we maintain that Wittgenstein hints in this direction. We also find in Wittgenstein elements of an account of language acquisition that takes the presence of qualia as an enabling condition. We conclude by pointing out some difficulties of this view.

For several decades, historians have realized the limitations of analysing the historical past of science as a mere succession of theories. One of the most stimulating messages that the reinvention of the discipline has launched is that although there are obvious intellectual elements that promote the development and progress of science, there are also social, economic, and institutional aspects to consider. The history of science is no longer just a history of scientific ideas and theories, but also a history of (...) institutions, communities, spaces, objects, and practices as well as a history of the complex interaction among all these dimensions. Accompanying this new panorama is a broad consensus among scholars to accept that major social changes have inexorably some impact on scientific practice and vice versa. This premise, now widespread, is especially relevant to the history of early modern science and the question of its roots because it has allowed the introduction of new agents and spaces previously excluded from the domain of scientific development. In other words, this enriched perspective has multiplied both the processes of knowledge construction and the arenas in which these processes were undertaken. More specifically, historical research is no longer limited to spaces traditionally linked to the construction of science; it now embraces less orthodox ones. Within this broadened field of inquiry, practical knowledge and the objects of material culture have come to occupy a central place. This special issue explores how the new directions in which the history of science has expanded have a direct impact on the study of Iberian science in the Atlantic world. (shrink)

This article aims to interpret an annual initiation ritual celebrated in Hellenistic Phaistos , at a festival known as the Ekdusia, in which young men had to put on women's clothes and swear an oath of citizenship before they could graduate from the civic youth corps and enter the society of adult male citizens. It begins by reconstructing the ritual and situating it within its historical and social context. It then reviews the two major theories which have been used to (...) explain transvestism in Greek initiation-structuralist and psychological-and attempts to expose their shortcomings. The author remedies the difficulty with the structuralist approach-its focus on abstract symbols divorced from their social context-by understanding the ritual change of clothes at the Ekdusia in terms of the radical gender segregation in Cretan society and the gradual transition Cretan boys made from feminine spaces to masculine spaces in both city and home. The author remedies the main problem with the psychological approach-its focus on the psychological dynamic between mother and son rather than the motivations of the rite's adult male sponsors-by looking at how adult men, particularly in modern non-Greek societies which hold initiation rites, understand male adolescent development and create rituals in accordance therewith. This comparative model shows how men in gender-segregated societies think of boys as feminine themselves and believe that their masculine development is at risk if they are not rescued from the dangerous feminine realm, and forced to undergo a combination of defeminization and masculinization rituals. Although there is no direct evidence to suggest that Greek men thought of boys' transition rites in this way, the myths told about three different figures named Leukippos, related directly and indirectly to the Ekdusia, reveal this pattern of thought in its full form. The Health System Food and Nutrition Units are designed to produce and offer balanced meals, establishing dietary patterns, maintaining and restoring the health of the individual. The control of dirty in leftover ingestion can lower costs and organic waste. The objective of the study is to quantify and analyze the leftover intake i meals served to patients, and ingestion of dirty leftovers in collective meals of a Food and Nutrition Unit, located in the Southwest of Paraná. The data were collected (...) in two weeks, being developed in two stages. The first was the determination of the leftover ingestion and dirty remains of the healthy collective, and the second quantification of the rest intake by the patients community. Two scales were used to obtain the total weight of the food distributed in the cafeteria. Vats were weighed, before and after lunch. The garbage bags were weighed in order to quantify the leftover ingestion. The results of total leftovers showed an average of 44.71 kg / day, with a percentage of 44.19% being unacceptable. The leftover intake presented 8.72%, being classified as bad with this waste331 people could be fed. In order to measure the leftover intake by the diseased community, the weights of three lunch boxes were collected; the number of boxes wss added, resulting in kilos of food distributed for the day. Weighing the bags of garbage, was 19.02 kg / day, representing 28.36% of leftover ingestion, being above the acceptable of up to 20%. Based on this data, 148 people could be fed, making it necessary to take in consideration organoleptic criteria, satisfaction surveys, their preferences and nutritional needs, both for the healthy and the diseased group. Scientific instruments are not neutral artefacts; the perception of their value is greatly determined not only by the objects themselves and the function they perform, but also by the context of their use. In the 16th and 17th centuries, scientific instruments – not only nautical ones – acquired a prominent place in European societies that greatly transcended the specific narrow professional circles that used them. This has already been noted as being an important feature in the development of science in (...) early modern Europe. But exactly how did this happen? Following other recent studies, I argue in this paper that in order to understand this phenomenon one has to look carefully at artisanal practices of the period. (shrink)

Este texto, composto no Japão por volta de 1650, pelo ex-jesuíta Cristovão Ferreira. consiste na versão japonesa de um Tratado de Esfera ocidental. com abundantes comentários e críticas por um erudito confucionista. No Kenkon bensetsu temos. assim, a circunstância rara de poder analisar, lado a lado, alguns conceitos fundamentais do pensamento (...) ocidental e o modo como foram recebidos pelo pensamento japonês do século XVII. Trata-se portanto de um documento de excepcional valor para se avaliar o intercâmbio cultural e científico entre a Europa e o Extremo Oriente nos séculos XVI-XVII, e é um dos testemunhos mais eloquentes e significativos da influência portuguesa no Japão. /// The Kenhon bensetsu (Treatise and Critic on Earth and Heavens) is the first systematic explanation of the astronomical and cosmological western principles that is translated to japanese. This text was composed in Japan about 1650 by the former Jesuit Cristóvão Ferreira, and is a japanese version of a western Sphere Treatise, including many commentaries and critics by a erudite confucionist. Thus, we have in Kenhon hensetsu the rare possibility to be able to analyse, side by side, both some fundamental concepts of western thought and the way they were received by the XVIIth century japanese thought. This is, therefore, a document of an exceptional relevance in order to evaluate both the scientific and the cultural interchange between Europe and the Far East during the XVIth and the XVIIth centuries. Seu último livro, Doutrinas (...) pedagógicas: máquinas produtoras de litígio, é um testemunho da originalidade inerente ao seu pensamento, que focaliza, dessa feita, o exame de algumas doutrinas pedagógicas, as quais, a partir do século XVII, operam direta ou indiretamente nos discursos a respeito da educação escolar. This essay attempts to offer some reflections on what it is that Jacques Derrida found uncomfortable in Martin Heidegger’s thought at the level of fundamental gestures. The region of disagreement is located in Derrida’s self-identification in a marrano register at an autographic level. This paper studies the notions of propriation and expropriation in Heidegger’s late texts and compares them to Derrida’s ‘uncanny propriation’ as a marrano notion. I offer four propositions regarding Derrida’s marranismo, which I align with Derrida’s proposal for (...) desecularization, tentatively described as a ‘messianic engagement with the khora’. I conclude with a proposal for the development of ontic models of marrano action that would antecede the theory/practice divide. (shrink)

Solving poverty is a laudable public policy goal. While there are many approaches, one that has gained popularity is the conditional cash transfer that requires recipients to satisfy conditions imposed on them such as requiring regular medical checkups. Another approach, which is gaining interest is unconditional cash transfers that do not impose conditions. The question we ask in this paper is: what do these past and current attempts tell us about the implications for gender? To answer this question, we explore (...) two programs using a gendered framework: Brazil's Bolsa Familia,which is a conditional cash transfer, and Manitoba's Mincome experiment, which was an unconditional cash transfer in Canada. We then consider how this information might be used by states, particularly as it relates to ending social marginalization. Broadly, this research contributes to academic discussions of public policy, income, gender and social vulnerability. (shrink)

The origin of the eukaryotic cell nucleus and the selective forces that drove its evolution remain unknown and are a matter of controversy. Autogenous models state that both the nucleus and endoplasmic reticulum (ER) derived from the invagination of the plasma membrane, but most of them do not advance clear selective forces for this process. Alternative models proposing an endosymbiotic origin of the nucleus fail to provide a pathway fully compatible with our knowledge of cell biology. We propose here an (...) evolutionary scenario that reconciles both an ancestral endosymbiotic origin of the eukaryotic nucleus (endosymbiosis of a methanogenic archaeon within a fermentative myxobacterium) with an autogenous generation of the contemporary nuclear membrane and ER from the bacterial membrane. We specifically state two selective forces that operated sequentially during its evolution: (1) metabolic compartmentation to avoid deleterious co‐existence of anabolic (autotrophic synthesis by the methanogen) and catabolic (fermentation by the myxobacterium) pathways in the cell, and (2) avoidance of aberrant protein synthesis due to intron spreading in the ancient archaeal genome following mitochondrial acquisition and loss of methanogenesis. Is it possible to find resistance in the thought of Michel Foucault? Amid the diversity of his ideas, would he have left us clues to think the resisting act? By directing his intellectual production to power dispositfs, by invoking the figure of the "specific intellectual", and, also, in the later years of his life, then turning towards the constitution of subjectivities, Foucault provides us with unique ways to conceive and operate resistances. In this article we explore two directions of the (...) resistances in the thought of the philosopher. One of them, the resistances coextend the field of power, keeping a special relationship with the specific role of the intellectual and with Philosophy. In second place, we indicate that the resistances are “starting points” or “key supports” for the issues that Foucault confronts in his work, becoming an essential part of your own research method. Como objeto da primeira experiência de satisfaçáo, das Ding fundará todo o encaminhamento do sujeito. Na estrutura neurótica, entretanto, o reencontro com das Ding é excessivo; o sujeito náo o pode suportar. É por trás dessa realidade sem predicaçáo que é das Ding que Lacan encontrará a realidade que ordena, a saber, a lei da interdiçáo do incesto. É nessa dimensáo que o sujeito, em análise, é convocado a advir. O presente estudo, portanto, tem como objetivo realizar esse percurso – do bem supremo aristotélico à ética do desejo –, apontando as contribuições da psicanálise à discussáo ética. (shrink)

In Fact, Fiction and Forecast, Nelson Goodman claims that the problem of justifying induction is not something over and above the problem of describing valid induction. Such claim, besides suggesting his commitment to the collapse of the distinction between the context of description and the context of justification, seems to open the possibility that the new riddle of induction could be addressed empirically. Discoveries about psychological preferences for projecting certain classes of objects could function as a criterion for determining which (...) predicates are after all projectible. In this paper, I argue that Goodman's claim must be construed within his project for constructional definitions, which is methodologically oriented by reflective equilibrium. The description of inductive practice is committed to the articulation of the extension of the class selected by the predicate ‘valid induction’. The mutual adjustment between theoretical considerations and inductive practice involved in the proposal of a definition of ‘valid induction’ must preserve that practice as much as possible, there is no way to get rid of entrenchment. Empirical discoveries about the psychological mechanism that underlies projections may help that adjustment but they cannot substitute the role played by the entrenchment of predicates. (shrink)

In this paper I claim that perceptual discriminatory skills rely on a suitable type of environment as an enabling condition for their exercise. This is because of the constitutive connection between environment and perceptual discriminatory skills, inasmuch as such connection is construed from an ecological approach. The exercise of a discriminatory skill yields knowledge of affordances of objects, properties, or events in the surrounding environment. This is practical knowledge in the first-person perspective. An organism learns to perceive an object by (...) becoming sensitized to its affordances. I call this position ecological disjunctivism. A corollary of this position is that a case of perception and its corresponding case of hallucination—which is similar to the former only in some respects—are different in nature. I show then how the distinguishability problem is addressed by ecological disjunctivism. (shrink)

The extended mind thesis claims that at least some cognitive processes extend beyond the organism’s brain in that they are constituted by the organism’s actions on its surrounding environment. A more radical move would be to claim that social actions performed by the organism could at least constitute some of its mental processes. This can be called the socially extended mind thesis. Based on the notion of affordance as developed in the ecological psychology tradition, I defend the position that perception (...) extends to the environment. Then I will expand the notion of affordance to encompass social affordances. Thus, perception can in some situations also be socially extended. (shrink)

RESUMOO presente artigo tem como objetivo analisar os meandros da composição e suas intertextualidades na polêmica do samba entre Noel Rosa e Wilson Batista, observando o dialogismo na interação verbal e musical entre os autores e os diversos textos da década de 1930. Ao apurar os ouvidos sobre a "polêmica do samba" observa-se que as composições revelam tensões inexoráveis entre um mundo festivo do "malandro" e os limites da realidade da época. Desse modo, com suporte em estudos que tratam deste (...) tema, busca-se trazer à tona um insight sobre este "duelo" musical que está, certamente, muito mais disseminado na sociedade que restrito a questões puramente estéticas.ABSTRACTThe purpose of this paper is to analyze the meanders of composition and their intertextuality in the samba controversy between Noel Rosa and Wilson Batista. We observe dialogism in the verbal and musical interaction between the samba writers and several texts of the 1930s. When ears are in tune with the "samba controversy," one observes that the compositions reveal inexorable tensions between the festive world of the "malandro" and the limits of the reality of the time. Accordingly, based on studies that address this theme, we aim to present an insight into this musical "duel," which is not restricted to purely aesthetics issues, but certainly disseminated in society. Este estudo tem como tema a biblioteca escolar, vista como um espaço pedagógico que promove a vivência empática, analisado em uma perspectiva antropológica e fenomenológica. A justificativa se baseia na dimensão pedagógica e antropológica da biblioteca escolar, que tem a pessoa humana como centro de seus processos e possibilita a reflexão sobre a experiência no mundo social e cultural, bem como a manifestação da intersubjetividade humana. O objetivo geral foi compreender a empatia como ato pedagógico vivenciado na biblioteca escolar, a (...) partir de um viés fenomenológico, e considerando a Base Nacional Comum Curricular (BNCC) e a Antropologia Filosófica. A pesquisa foi de natureza teórica, bibliográfica, exploratória e descritiva e se delimitou no conceito de empatia na Antropologia Filosófica e na BNCC, com a finalidade de problematizar e investigar se a vivência empática pode contribuir para o ato pedagógico na práxis cotidiana da biblioteca escolar. Os resultados apontaram que a biblioteca escolar, ao aplicar a vivência empática em sua dimensão pedagógica mediadora, revela a sua concepção antropológica e se constitui como um lugar privilegiado para o ato educativo empático, a pedagogia humanizadora, o diálogo, a reflexão sobre o outro, a promoção do respeito e dos direitos, a formação cidadã, o acolhimento à diversidade social e cultural, a abertura para a subjetividade e as relações intersubjetivas humanas. O presente artigo deseja evidenciar que, ainda que a libido e a sexualidade tenham sido incluídas no conceito de Eros a partir de Além do princípio do prazer, a sexualidade no interior no pensamento freudiana não perdeu seu caráter disruptivo e não deixou de ser considerada como causa de profundas perturbações para a vida psíquica humana. Para tal, serão reconstruídos os argumentos sobre a natureza conservadora das pulsões e se procurará propor a ideia de que os conceitos de expansão, repetição (...) e conservação, intimamente associados à dinâmica pulsional, não podem ser vistos como elementos que teriam retirado à sexualidade sua natureza disruptiva e conflitiva no interior da obra freudiana. O objetivo deste artigo é analisar a concepção de Justiça Internacional em Kant e Rawls e colocá-las em diálogo. Os eixos de análise serão o direito cosmopolita (Weltbürgerrecht) de Kant e o direito dos povos de Rawls. Nesse sentido, os setores internacionalistas dessas teorias serão discutidos e comparados em seus principais componentes, como a visão dos autores sobre a guerra, a imigração e a obrigação de acolhimento de refugiados. Buscar-se-á, ao longo do artigo, colocar essas teorias lado a lado com (...) o direito internacional moderno, e com alguns institutos de proteção do ser humano, como os direitos humanos e o direito dos refugiados. Ao final, buscar-se-á ponderar como esses autores conceberam a factibilidade de suas teorias, demonstrando que ambas podem ser consideradas “utopias realistas”. Esses temas foram escolhidos por estarem estritamente vinculados à temática da justiça internacional e aos desafios mais urgentes dessa disciplina. Nesse sentido, a análise das teorias de dois grandes expoentes da filosofia política será o pano de fundo para buscar tecer algumas considerações sobre o problema dos refugiados no mundo contemporâneo. In this paper, I try to articulate and clarify the role of the epistemic authority of experts in Kuhn’s explanation for the transition process between rival paradigms in the scientific revolutionary period. If science progresses, that process should contribute to the attainment of the cognitive aim of science, namely, the articulation of paradigms increasingly successful at the resolution of problems. It is hard to see that process as rational and as attaining the cognitive aim of science without the consideration of (...) epistemic authority.The mistake of Kuhn was to emphasize and clarify insufficiently the role of the epistemic authority of experts; his critics failed for ignoring it altogether.
